Platform Privacy Policy

These policies apply to this Platform ("Platform") Properties ("Properties"), Content ("Content") and Services ("Services") created, maintained, and offered by ReallyCool Technologies, LLC ("ReallyCool Technologies") through online Platform Properties including FoodTruckYP.com, FoodTentYP.com, FaireTentYP.com, FaireTruckYP.com, FTYP.co, and subdomains connected to these domains.

When you use this Platform you trust us with your information. This Privacy Policy is meant to help you understand what data we collect, why we collect it, and what we do with it.

In some cases your use of the Platform will be by way of a user account ("Account") which will be associated with your email address and other Personal Identifying Information ("PII"). We keep the amount of PII we collect and store to a minimum, and you are able to audit and remove this information at any time.

In many cases, your use of the Platform may be as an anonymous web user or consumer by other means, in which case we may not associate your access to our Services and Content with any PII. Some data is still collected and some cookies may be stored in your web browser as an anonymous user.

This Platform is designed primarily to promote and benefit our subscription customers ("Customers"). We also work with hosts ("Host") and organizers ("Organizer") to coordinate some parts of various types of events ("Events") with our Customers. Together all of these entities ("Entities") are entitled to record-keeping and statistical reporting from the overall operation of the Platform as it impacts their respective concerns. In the case of aggregate reporting, individual PII is not shared with our Customers. In cases where personal information is shared, it will be in specific scenarios described below.

Introduction

There are many different ways you can use our Platform – to search for and share information, to communicate with other people or to create new content. When you share information with us, for example by creating an Account, we can make those services even better.

In addition to serving our Customers, and Hosts, and Organizers, we use Account information to show you where to find mobile vendors you already patronize, to find new mobile vendors that may be appealing, to enable you to invite mobile vendors to participate in your own events, to help you connect with mobile vendors or to make sharing with others quicker and easier. As you use our Platform and Services, we want you to be clear how we are using information and the ways in which you can protect your privacy.

Information We Collect

We collect information to provide better Services to all of our users – from which language you speak, to which vendors you will find most interesting, the events that matter to you, or when your selected locations can be associated with mobile vendors you might enjoy visiting.

Information we collect directly

For example, some of our Services require you to sign up for an Account. When you do, we’ll ask for personal information, like your name, email address, social media links, and other information to associate with your account. If you want to take full advantage of the sharing features we offer, we might also ask you to create a publicly visible Platform Profile, which may include your name and photo.

If you use the Platform and Services to Organize or to Host an Event, or if you collaborate with a Mobile Vendor as part of the Event logistics process or in administering the operations and logistics of one or several Events, we collect and store information about the Event and the Entities involved. Your personal Account information is associated with transactions before, during, and after each Event for transaction history and audit purposes.

All of the Services on the public-facing Platform may be used without a personal Account.

From your use of our services

We collect information about the Services that you use and how you use them, such as when you search for mobile vendors or events. This information includes:

Device information

Using third-party services such as Google Universal Analytics, we collect device-specific information such as your hardware model, operating system version, unique device identifiers, and mobile network information. We may associate your device identifiers as needed for debugging the Platform.

Log information

When you use our Services or view content provided on our Platform, we automatically collect and store certain information in server logs. This includes:

NOTE: Our Platform is deployed on Amazon Web Services infrastructure and uses Elastic Load Balancer features, including IP address proxying. Your IP address is accessible internally but in general is not logged unless there is a specific need to track criminial activity such as hacking attempts, automated system abuse, and similar. The traffic logging features of the Elastic Load Balancer are not enabled.

When you use our Platform or Services, we may collect and process information about your actual location. We use various technologies to determine location, including IP address, GPS, and other sensors that may, for example, provide us with information on nearby devices, Wi-Fi access points and cell towers. Because our services are offered through your web browser, access to location information is not continuous and is generally obtained when you submit your location specifically.

Local storage

We may collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.

Cookies and similar technologies

We and our partners use various technologies to collect and store information when you visit our Platform, and this may include using cookies or similar technologies to identify your browser or device. We also use these technologies to collect and store information when you interact with services we offer to our partners, such as advertising services or features that may appear on other sites. We use the Google Universal Analytics product to help our users, their businesses, and our developers analyze the traffic to our Platform.

Information we collect when you are signed in to our Platform may be associated with your Account. When information is associated with your Account, we treat it as personal information.

We do not associate Personal Identifying Information with any web URLs that may be tracked using Google Universal Analytics or similar services, or AddThis or similar social sharing services.

Loyalty programs

If you have created a personal Account, you may choose to participate in one or more Platform Loyalty Programs associated with Events and Entities using our Platform. In this case, individual transactions and associated data, including time, location, and a transaction value, as well as transaction history, will be shared with the related Entities to enable their use of the Loyalty Program. In exchange, participation in a Loyalty Program will yield some promotional benefit, including but not limited to discounts on goods or services, special access to events, goods, or services, or some other benefits.

It is not necessary to share Personal Identifying Information with our Customers as part of a Loyalty Program. Our Customers would see a unique user identifyer but not name, email address, or other PII.

How we use information we collect

We use the information we collect from all of our Services to provide, maintain, protect and improve them, to develop new Services, and to protect our Platform and our users. We also use this information to offer you tailored content – like giving you more relevant search results for nearby and interesting mobile Vendors and Events.

We may use the name you provide for your Account across all of the Services we offer. In addition, we may replace past names associated with your Account so that you are represented consistently across all of our Services. If other users already have knowledge of your email address, or other information that identifies you, we may show them your publicly visible Account information, such as your name and photo.

If you have an Account, we may display your Account name, Account photo, and actions you take on our Platform or in our Services.

When you contact our support services, we may keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements.

We will ask for your consent before using information for a purpose other than those that are set out in this Privacy Policy.

We may process your personal information on a server located outside the country where you live.

Transparency and Choice

People have different privacy concerns. Our goal is to be clear about what information we collect, so that you can make meaningful choices about how it is used. Accessing and updating your personal information

Whenever you use our Services, we aim to provide you with access to your personal information. If that information is wrong, we strive to give you ways to update it quickly or to delete it – unless we have to keep that information for legitimate business or legal purposes. When updating your personal information, we may ask you to verify your identity before we can act on your request.

We may reject requests that are unreasonably repetitive, require disproportionate technical effort (for example, developing a new system or fundamentally changing an existing practice), risk the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup systems).

Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of this, after you delete information from our services, we may not immediately delete residual copies from our active servers and may not remove information from our backup systems.

With your consent

We will share personal information with external companies, organizations or individuals when we have your consent to do so. We require opt-in consent for the sharing of any sensitive personal information.

Creation of a personal Account and storing associated Location information implies consent to share aggregate location information with Entites using our Platform. This enables our Customers to make informed decisions about operating Locations to benefit their own business.

Creation of a personal Account and participating in one or more Loyalty Programs implies consent to share specific transaction information with specific Entities based on the specific Loyalty Program. This may include the transaction value, the location and time of the transaction, and a history of transactions associated with that Loyalty Program.

For external processing

We may provide limited personal information to trusted businesses or persons to process it for us, based on our instructions and in compliance with our Privacy Policy and any other appropriate confidentiality and security measures. Examples of these trusted businesses include but are not limited to Google Analaytics, Amazon Web Services, and OpenStreetMaps. In cases where location, time, or other similar information is provided with an association to your personal Account, you will be made explicitly aware. These cases will be rare and limited.

We will share personal information with external companies, organizations or individuals if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to:

If the Platform changes ownership or business structure

If ReallyCool Technologies is involved in a merger, acquisition or asset sale as related to this Platform in part or whole, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy, with an opportunity to opt out of and delete that personal information.

Our Privacy Policy applies to all of the services offered at or by ReallyCool Technologies and its affiliates with regard to this Platform, and Services offered on other sites, but excludes services that have separate privacy policies that do not incorporate this Privacy Policy.

Our Privacy Policy does not apply to services offered by other companies or individuals, including products or sites that may be displayed to you in search results, list or map views, or in any Service which incorporates third party data access. We will continue to make every effort to inform you of our interaction with third parties where our interactions may impact your privacy.

Compliance and cooperation with regulatory authorities

We regularly review our compliance with our Privacy Policy. We also attempt to adhere to several self regulatory frameworks, including the EU-US Privacy Shield Frameworks. When we receive formal written complaints, we will contact the person who made the complaint to follow up. We work with the appropriate regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that we cannot resolve with our users directly.
